Kavanaugh offers lengthy judicial record ahead of bitter confirmation fight

On Monday, President Donald Trump exercised "one of the most profound responsibilities of the president of the United States", choosing a Supreme Court nominee, Judge Brett Kavanaugh.

President Donald Trump is going down to the wire as he makes his choice on a replacement for retiring Supreme Court Justice Anthony Kennedy, but he says with his final four options "you can't go wrong".

Trump is scheduled to announce his nomination to replace Supreme Court Justice Anthony Kennedy at 9 p.m. on July 9.

Kavanaugh also credited his mother as having "overcame barriers", becoming a Montgomery County Circuit Court judge in 1993.

"Just as they held the Merrick Garland seat open on the Supreme Court, they also held open an bad lot of vacancies on the district courts and the courts of appeal", said Russell Wheeler, who tracks judicial nominations at the Brookings Institution.

Mr Trump described his nominee as "one of the finest and sharpest legal minds of our time" and as a "judge's judge".

The White House is hoping the Senate moves quickly to confirm Kavanaugh before the midterm elections in November threaten to unfurl the narrow Republican majority in the chamber and nix the precious leverage the GOP holds over some red state Democrats up for reelection in 2018. One night after Kennedy announced his retirement, Trump met with Democratic Sens.

Perhaps the most intense issue that advocacy groups will focus on during the contested confirmation hearings to follow will be whether Kavanaugh may vote to overturn the seminal 1973 Roe v. Wade decision that ruled that the right to abortion was constitutionally protected. Of the court's liberal justices, Ruth Bader Ginsburg is 85 and Stephen Breyer turns 80 next month, so President Trump may well get another opportunity to cement conservative dominance of the court for years to come. If confirmed, Trump's choice would solidify the high court's conservative majority and continue the president's push to shift the federal bench to the right.

Conservatives have taken issue with a potential Kavanaugh nomination, with some critics on the right citing his closeness to the Bush 43 administration while others believe he doesn't have a strong enough stance against abortion. "But in my respectful judgment, deciding the constitutional issues in this case at this time would contravene an important and long-standing federal statute, the Anti-Injunction Act, which carefully limits the jurisdiction of federal courts over tax-related matters". Three Democrats up for re-election in states Trump won by double digits in 2016 - Indiana Sen. Susan Collins of ME and Lisa Murkowski of Alaska, to oppose any nominee who threatens Roe v. Wade. "Barrett said she tends to agree "with those who say that a justice's duty is to the Constitution", rather than a precedent she thinks is clearly in conflict with it".
