In Our View: Energy Rule Costly, Deadly

The new rule effectively reverses President Obama's efforts to cut power plant carbon pollution under the proposed Clean Power Plan. The intent of the Clean Power Plan was to choose winners and losers with the nation's energy generation - and to the detriment of states such as IN that use coal as a main source of electricity.

The U.S. Environmental Protection Agency (EPA) proposal would give states wide latitude for determining how to cut greenhouse gases from the power sector, a key contributor in the U.S.to climate change.

The EPA wants to replace the Obama administration's Clean Power Plan, which would have required states to move away from fossil-fueled power plants to reduce the nation's carbon emissions by 32 percent over a 25-year period.

The Obama administration's Clean Power Plan has been put on hold since 2016 after pro-coal states and industry challenged it in the courts.

Acting EPA Administrator Andrew Wheeler signed ACE into effect earlier this week and reported that the rule allows each state to make its own regulations regarding their emission standards for coal-fired plants.

According to the EPA's announcement, the new rule will replace the Obama administration's Clean Power Plan, which it describes as "overly prescriptive and burdensome". The states claimed that the EPA was overstepping its bounds and doesn't have the authority to regulate greenhouse gas emissions from coal under the Clean Air Act.

But the Washington Post reports that compared with Obama's plan, the new rule would allow plants to release 12 times the amount of carbon dioxide over the next decade. We're going to have more asthma.

Many analysts view the relaxed legislation as an appeal to the coal industry.

Assistant administrator for the Office of Air and Radiation Bill Wehrum told reporters on Tuesday that the short-term, rate-based test aligns the New Source Review programme with other EPA standards. "The levels of acid rain we receive and the amount of ozone pollution we experience is more determined by actions in these upwind states than in NY itself", Horwath said. "Climate change is real", McCarthy said.

Rep. David McKinley, R-W.Va., the chairman of the Congressional Coal Caucus, said Trump is keeping his promise to "revitalize the coal industry".

It also acknowledged that the increased emissions from aging coal-fired plants could kill hundreds more people annually and cost the country billions of dollars. Critics say it is a blow to clean air.

While coal accounts for about one-third of U.S. electricity production, the power industry has already in recent years shifted from coal to cleaner natural gas and renewables due to cheaper prices.

One claim running through justifications for the ACE is that the previous administration was exceeding the bounds of what was always known as cooperative federalism, the idea that states and the federal government can work together as partners in protecting environmental quality. The ACE rule focuses on efficiency improvements to reduce emissions.
