Supreme Court ends legal fight over Obama-era net neutrality rules

Three of the Court's justices - Clarence Thomas, Samuel Alito and Neil M. Gorsuch - would have voted to take up the case, according to the Court's announcement, and overturn a lower court's decision backing the Federal Communications Commission's net neutrality rules, which were originally passed in 2015.

The Trump administration had warned that it would ask the high court to step in if the appeals court didn't rule by October 31.

Because none of those appeals courts has yet ruled, the Administration decided last month that it could not wait for that to happen because, it concluded, time was running out for the Supreme Court to review and decide during the current term the legality of the shutdown plan. That, it noted, would put all of the cases before the Supreme Court, pulling them away from the appeals courts so that the lower courts could not then go ahead and rule on the program while the Supreme Court's review continued. And the Justice Department acknowledged in Monday's request that the appeals court ruling is likely to come first. Four of nine justices must agree to hear a case, but only three voted to grant the petitions. Sensing that those efforts might succeed, Texas and seven other states filed a separate lawsuit in hopes of having the program declared illegal. But today the Supreme Court refused to do so. In his ruling on U.S. Telecom Association, Kavanaugh called net neutrality "unlawful" as the 1934 Communications Act "does not supply clear congressional authorization for the FCC to impose common carrier regulation" on internet service providers (ISPs).

"The last administration started DACA without a mandate or even an authorization from Congress or the courts; this administration can therefore end DACA at any time", Attorney General Jeff Sessions said in a statement Monday night.

The policy has shielded from deportation immigrants dubbed "Dreamers" and given them work permits, though not a path to citizenship. The Trump administration is seeking to convince the Supreme Court to consolodate those cases because they make the same substantive objections to the planned DACA recession, and toss them all out on the merits.

Last month, frustrated by delays, the department filed notice that it would seek the high court's intervention if the 9th Circuit court did not rule by October 31.

"It is assumed that the Court of Appeals will proceed expeditiously to decide this case", the Supreme Court's February order read.
