Trump plans order to end birthright citizenship for migrant babies

US President Donald Trump is planning to sign an executive order that aims to end the right to US citizenship for children of non-citizens born on US soil, he said in a television interview taped on Monday.

In an interview with Axios published on Tuesday morning, Trump called the practice of giving citizenship to all children born in the U.S. "ridiculous" and announced his plans to sign an executive order banning it.

Former U.S. attorney Andy McCarthy said Tuesday that President Trump is "right on the substance" when it comes to the 14th Amendment and potentially curbing birthright citizenship.

"It's ridiculous. It's ridiculous".

"They're saying I can do it just with an executive order", Mr Trump said.

The 14th Amendment to the United States Constitution passed in 1868, giving citizenship to newly freed slaves after the Civil War. "We should change our Constitution and say if you come here illegally and you have a child, that child's automatically not a citizen".

But the citizenship acquired by virtue of the circumstances of birth has been in controversy for some time now as few people are of the opinion that the United States is the only country offering such a benefit and that it should be revoked. This has been a constitutional right to the United States citizenship for the US-born children. It also guarantees citizens "equal protection" under US law.

However, critics are saying the practice stems from a misinterpretation of the 14th Amendment.

Mr Trump also said it was "ridiculous" that you get citizenship if you are born in the United States and not a citizen. "It's in the process it will happen, with an executive order that's what you're talking about".

It was unclear what specific action his order would pursue, and Trump gave no other details. Birthright citizenship allows any baby born on US soil to automatically be a USA citizen.

"I think the 14th Amendment is clear in enshrining birthright citizenship in the law, and there is interpretive case law from the Supreme Court supporting this", Siskind told Business Insider.

House Minority Leader Nancy Pelosi said that she's more confident about the midterms for Democrats than ever before, vowing on CBS's "The Late Show With Stephen Colbert" that "we will win".
